Rick's check goes into our account by direct deposit on 12:01 AM on every other Friday. He got paid this past Friday, so I paid the bills. Later in the afternoon, I made a deposit of 3 checks totalling $101.08. After asking the person at the drive thru if I would be able to withdrawl these funds immediately (and he said yes), I then made a cash withdrawl for $100.00.

Now I have 4 returned check fees on my account for bills I paid earlier that day (Friday). At $33.00 each, that is $132.00! All of my grocery and gas money for the next 2 weeks!

Apparently by the banks standards, even though the withdrawl was made within minutes of the deposit, my account was overdrawn because the deposit wasn't posted until Monday, Whereas the withdrawl was posted at the very time I made it. These transactions were made within minutes of each other.

I just got off the phone with the banks customer service rep and one of the supervisors. Although the supervisor was VERY kind, in the banks eyes it is my fault. Explain to me why this is my fault? I made a deposit to cover the w/d I was making.

On top of this, when we checked the account on Saturday evening we saw that it looked like it would be overdrawn. The account overdrawn/account pending (which we took to mean they were holding one of the checks I had had deposited and that was why it was going to be overdrawn) and showed the four fees as well as the w/d and deposit. So we transferred $130 from our other account, just in case. So with the transfer and deposit and withdrawl, that should have put us up $131.08. I had planned on transferring the $$$ back to the other account today so I could go shopping. INstead, we are now overdrawn almost $30. If we hadn't made that transfer, it would be even worse!

Rick and I are both livid about this. I just talked to him on the phone. If he can't get it straightened out, then we are closing all 3 of our accounts with them. We have had more problems with them in the past few months than we have had in the past 10+ years we have had this account.

Am I wrong? I told the supervisor that not only did I think this was wrong, but as far as I was concerned it should be illegal. It's like they are stealing from their customers!

That is totally wrong. I know around here in a stiuation like that they will usually fix it and reverse the fess.

If I had known this would happen, I would have deposited them in the other acoount. I was just putting them back into the account the charges had originally come from (fundraiser for Drew's school that I paid for for SIL & MIL).

Rick talked to another supervisor. It took about 30 minutes, but in the end he agreed to refund 2 of the charges. They agreed that no one was right or wrong (I disagree), so the guy was willing to split the difference.

I guess I can live with this. Now the account has a balance of a little over $30. I still lost most of my grocery money. Luckily, the car is almost full of gas, so I don't have to worry about that right now. Guess I will only be getting essentials at the store this week. *grumble, grumble, gripe, gripe*

If they only split the charges with you I would still pull all of my accounts with them! It is not right that he told you you could withdrawal the funds and then you get charged fees for that. IF you make enough stink and go high enough you should get your money back.

I agree about just cashing your checks. My mil had to start doing that because her bank was giving her OD fees because she took out money after she deposited. I Do not think that is fair that they can take the time to put in your w/d and checks, but they won't put in any deposits. How freakin lazy is that? what @ssholes!

I was looking up some banking laws the other day. Technically, they have to add deposits to your account before they subtract any checks or charges. This really screws things up if it is done just before a holiday or before the weekend because anything done after 4PM on Friday isn't posted to your account until Monday afternoon. HOWEVER, if you make a CASH withdrawl, then that is subtracted from your account immediately.

Somehow, this doesn't make sense. If a check hits your account at 5PM on Friday, it won't post until Monday afternoon. But if you take cash out at 5PM on Friday, it is subtracted immediately.

The way I was reading the law, ALL debits to your account after the cutoff time are supposed to be posted to your account THE NEXT BUSINESS DAY - The same for deposits (which HAVE to be posted BEFORE any debits). The way the law reads, one would think this applied to cash withdrawls as well as any checks or debit card purchases. But obviously it doesn't.

I still think I should write a complaint to the bank, but Rick doesn't want me to.

My bank says if I add money before 2:00 it will be added that business day but if I add it later then 2:00 it won't be added til the next business day.

It stinks. The guy should have just told you that you'd be better off cashing the checks you had not depositing them.

At my last bank, direct deposit was available immediately. If you deposited cash, it was available immediately. If you deposited checks, then your first $100 of your deposit was available immediately. At the new bank, I think everything is next day, although if you make a deposit and a withdrawal at the same time, they are usually OK with that.

I can't believe that that guy told you that if it was wrong. That is why I left my last bank. I had too many cases where they gave me bad information and then wanted me to pay the fees for their employee's misinformation.

That's how I feel, Dina. I mean, I DID ask the guy if it would be alright. Yet I get penalized because the employee didn't give me the correct information. That is just WRONG!

Did you tell them how you even asked the teller if you could withdraw then and they said yes?! That is nuts! I know with my bank, everything goes through at midnight on the day they try to post to your account, and deposits go before credits. That keeps me safe sometimes!

That is wrong!!!!!! I hope you get it all settled!!! I would switch accounts even if they do fix the problem!!!

Yes, they know that I asked the guy before I made the w/d at the ATM. But apparently that doesn't matter!

Rick wants to wait on changing banks because we have direct deposit thru the VA and it takes a while to set it up. So that means that I have to research banks and get a new account set up first.

If the supervisor split the charges with you then he was adimitting an error. That means he should refund the ENTIRE amount. I wouldn't stop with the branch manager...call the regional manager (they should give you his/her name and number) explain your situation and ask him to look at the history of your account and they can see this isn't a problem all the time. A mistake was made because you received bad info from a bank employee.

Letting them know they are putting you in a negative cycle usually makes them feel bad and a couple of tears wouldn't hurt anything either!

I worked in banks for almost 10 years, I know what works!

Oh, one more thing...don't come off as bi*chy (like I usually do) that just aggravates the situation. Niceness (even fake )goes a long a way in getting your way! And your money back!

Don't forget to add the fact that your children will have no food for the next two weeks and that your husband is a diabetic who needs to eat certain types of food to stop him from getting sick

In both NZ and OZ you have to wait 7 working days before you can withdraw funds against a cheque deposit, altho it has been changed to 5 working days now. And if you want it to be cleared quickly (3 working days) it costs you $30 to get it cleared.

If you want to cash a cheque you have to take it to the bank and branch that the person who issued the cheque banks with.

Needless to say very few people use cheques in either country, we all EFTPOS or Credit Card instead. (Wages are paid by DD)

Maree, I can remember years ago when you had had to wait 5-7 days before you could access any deposited funds. You were allowed to take out up to $100 of your deposit and the rest had to wait.

But a civil suit was filed against the banking community and the laws were changed because of it. It was found that the bans could not deny you access to your own funds. They are still allowed to hold out of state checks (I think it is 3-4 days), but local or in-state checks are available immediately. That's why they have the cut-off times and such. Gets kinda confusing.

Wait until you read about what they did now!

Things up here are alot the same as in NZ and AUS... cheques are rarely used anymore. eftpos and credit cards... and they are all instantly out of your account...

so after i go shopping, with my debit card i come home and check my account and the total is exactly what is there...
