Sen. John Kerry Intervenes on Behalf of Missing Soldier's Illegal Immigrant Wife

WASHINGTON — Sen. John Kerry, D-Mass., has asked the Department of Homeland Security not to deport the wife of an Army specialist who is missing in Iraq while the search continues for him, his office said Wednesday.

Army Spec. Alex Jimenez has been missing since May 12, when his unit was ambushed by insurgents. His wife, Yaderlin, entered the country illegally in 2001, according to Kerry's office, and the two married in 2004. Procedures to deport Yaderlin Jimenez have begun, although an immigration judge has halted the proceedings while the search for her husband continues. The two are from Lawrence, Mass.

"Under no condition should our country ever deport the spouse of a soldier who is currently serving in uniform abroad," Kerry said, in a statement provided to FOXNews.com.

I have mixed emotions on this one. Obviously, I am saddened that they would deport the wife of a solider that is MIA, however, they didn't really ellaborate on why she was in the country illegally.

Oh ... and might I add that I'm not surprised that John Kerry decided to step up to the plate? After all, he's not exactly a favorite among the military. Perhaps he hopes this will help smooth over his "end up in Iraq" comment??

If he's a US citizen and they married, I would think she would be legal. Oh and don't get me started on Kerry....

I think the issue is that she arrived here illegally, lived here for three years illegally, then married him. Does marriage automatically get you a green card? I don't know on that one.

I do, however, think it is right that they hold off on proceedings until he is found.

I thought marriage made you legal. We work with LOTS of illegals where I teach and the kids are terrified they'll be "taken" since most were not born here either. Being born here makes you ok but having a child here does not qualify the parents as legal. I'd be interested in the real answer to this.

I thought so too, but now I'm not so sure it's that easy. Do you remember the story of the foreigner who was to be deported after her husband was killed on 9/11? I never did hear how that story ended, but it was similar (even though I believe she was here legally).

What I find interesting here is that nobody tried to deport her UNTIL her husband went missing. If you're going to allow somebody to stay in the country because they married an American, then I think she should at least be allowed to stay until her husband's status is changed to KIA. If he turns up alive, are they going to allow her to stay?? I'd be interested to hear what the answers to these questions really are.
