Poliece say a Grandmother was scared to death.

Not really sure what to think of this story. With the her health the way it was, it seems she was a ticking time bomb.

Well, it wasn't cold blooded murder and who knows if it was just her time. But I don't know how I would feel if it was MY grandmother. I'm glad I'm not on that jury!

If I were the prosecution I would probably go for manslaughter or reckless endangerment or something. I don't think a jury is going to buy 1st degree murder unless it can be shown that he intentionally intimidated her or tried to scare her.

In some states, it would be considered 1st degree murder, because she died during the commission of a felony (burglary), even if he didn't lay a finger on her. If that is the case where this took place, and it's proven that he committed the burglary, and that she died as a (medically reasonable) result of his commission of the crime, then I'd have to say "convict him".

Imagine someone is driving drunk, swerving all over the road. If the drunk's driving causes someone else to swerve and hit a pedestrian, the drunk is (or should be) responsible for that incident, even if the drunk's car never touched the other car, or the pedestrian.

He attempted to rob a bank and was thwarted. He attempted to run away and was thwarted. He just tried to hide and the woman dies. He is just a as a criminal. As this is his first offense and he was only attempting to commit crimes, I don't think he is a cold blooded murderer.

My grandma had all those conditions. She died shortly after walking in on my cousin who was 17 at the time and his male lover. Some say the shock killed her. People die after witnessing something surprising all the time. Maybe they should charge the deceased with being a danger to herself. She harmed herself more than he did. He didn't make her morbidly obese and give her all those health problems. She did that on her lonesome.

I think there is hope this man can be reformed and turned into a productive member of society again. He just sounds desperate and scared to me. Yeah, he should be charged with breaking and entering which is all he actually did.

I expect what will happen is he will enter a plea to a lesser charge, like involuntary manslaughter, in addition to the other crimes he committed. He's probably still looking at 25 years in prison, though.

I hope not, because I think he can be reformed. He lived a fine life up to this point. He even looks scared in his prison pics. In this economic downturn that's only going to get worse, we can expect to see a lot more desperate people who would never have committed a crime in their life if things had been better, attempting robbery. Not that it is right, but people are scared and desperate.

He was quite polite for a burglar.

I'm saying 25 years for all the other charges - not including any charge stemming from the woman's death. I could be wrong, of course. And we all know, 25 years really means about 7 years + parole, with good behavior.

I hope you're right, that he can be rehabilitated. The jails are filled with enough people who made bad decisions, IMO.

There is a big lesson in this for us overweight ladies, if you don't want the shock of seeing your grandson playing tight end in the bedroom to knock you down dead or any other shock life might send your way, it's time to work out!

I would much rather see him charged with involuntary manslaughter. He had no intention of hurting her. He did nothing to cause her heart attack. While he needs to be tried and convincted of the charges of attempted robbery, I don't think he should be charged with murder. That is just wrong. He murdered no one.

It's one of those cases it seems like the Marines or jail could help. That program is not for everyone. Becoming a Marine and being a successful Marine is far from easy. It's not letting someone off lightly.
