He got a letter today from the unemployment office that says:

Claimant was discharged from most recent work. No evidence was presented by the claimant's employer for the reason of claimant's discharge. The claimant did not willfully turn off his machine nor did he know he was in violatin of company policy.
The employer has not provided sufficient evidence to prove the claimant's actions constitute work-related misconduct. Therefore under Tenessee code annotated **-*-***, benefits are approved as of the claim date shown below. ( 6/28/04)
Employer response: Not Timely
Response received: 7/09/04

So I guess he's approved for unemployment as of 6/28/04..I wonder if that means he'll get paid for 2 back weeks, b/c he didn't get a check last week and he hasn't gotten one this week either. I'll never understand this stuff. At least they didn't find him at fault!

Oh and either party has until 7/27 to appeal the decision...of course we're not going to appeal it

Yay! Good news! I'm not sure about Tennessee, but here in NC, there is a 1-week waiting period. That means you don't get paid for the first week you're out, but will receive benefits for weeks 2 through until another job is found.

It's going to be hard for them to appeal since they didn't even bother to respond to the claim!

That's how it is here too Dawn...he'll get one check this week, and that's for last week! It's way better than nothing!

I hope they don't contest it!

Oh, and just think about this, I am STILL waiting on my unemployment claim which I even had a trial! It has been at least 6 months.
